[Jo] Malone is now being sued by Estée Lauder for breach of contract, trademark infringement and “passing off” — a term in English law that refers to misleading consumers into thinking that goods or services are connected to another business.Last year Jo Loves launched a new affordable perfume collaboration with high street retailer Zara. The perfume’s packaging includes the wording “A creation by Jo Malone CBE, founder of Jo Loves”.

I was a big fan of Jo Malone perfumes when she first started her business, not so much of the products when Estee Lauder bought her business & seemed to launch a new fragrance in their Jo Malone range every other week! Equally, I was & still am a fan of Ms Malone’s Jo Loves perfumes, & some years ago now the friend I go to London with every December & I went to her shop & had a lovely time trying the at the time small selection of fragrances she had recently launched. My husband loved her Pomelo & my best friend’s husband loved the Pomegranate Noir.
She has lots of fans…I am still surprised she sold her name.

I happened to read this article in Financial Times and then I saw it mentioned here. I am still surprised she sold her name rights too. I felt the same when Bobbi Brown did too, which the article briefly mentioned. They were both very much compensated with money for doing so, but still if you built a company yourself I can’t imagine selling it after working on it for years and losing control over what a company named after yourself does with the products.
I am not surprised. I wasn’t understanding how she can have her perfumes with almost the same name at Zara. She is always promoting her Zara perfumes on Instagram.
Not surprised either, and would think EL would prevail.
Wonder if that means the end of those JM Zara perfumes? Better get while the getting is good, I guess.
It’s a question, whether they would bother if it was just “Jo Loves”.
